Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.177 dated 19.08.2018 under Sections 307, 34 IPC, Section 25 of the Arms Act and Section 61 of the Excise Act, registered at Police Station Jandiala, Amritsar. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that as per the FIR, when the police party tried to stop the vehicle, then present petitioner, who was sitting on the co-driver seat, fired upon the police party from the gun and the Asstt. Sub Inspector saved himself by bending low.
The present petitioner is the main accused. He is named in the FIR. He was armed with deadly weapon and also fired a shot from the gun VINEET GULATI 2018.10.30 15:09 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-46298 of 2018 -2upon the police party. The gun is still to be recovered. Keeping in view the facts and circumstances of the present case and nature and gravity of the offence, I find that petitioner is required for custodial interrogation and no ground is made out to grant anticipatory bail to him.
Therefore, finding no merit in the present petition, the same is dismissed.
