In a private complaint, on account of petitioner having not put in appearance pursuant to the summoning order and having not made himself available thereafter, the order declaring him proclaimed offender has been passed.
Counsel submits that the petitioner had not been served. Without entering into the controversy regarding reasonableness for non appearance or the knowledge of the petitioner regarding pendency of the private complaint, I deem it appropriate to dispose of this petition in limine with a direction that in case the petitioner puts an appearance before the summoning/ trial court within a period of one month, he will be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the concerned court, without prejudice to the other rights of the petitioner. In case the petitioner does not put in appearance within a period of one month, this petition will be deemed to have been dismissed.
