Learned counsel for the petitioner-complainant very fairly concedes that present petition is not maintainable as vide the impugned order, the respondents No.2 to 8/accused have been discharged and therefore, revision petition ought to have been filed before the Court of Sessions. Learned counsel for the petitioner however, submits that in view of the fact that this is a petition of the year 2017, question of limitation would stand against the present petitioner. Learned counsel submits that he may be permitted to withdraw the present petition with liberty to approach the Court of Sessions. However, limitation be not allowed to stand in the way of the petitioner in filing the revision petition. Dismissed as withdrawn with liberty as aforesaid.
