Naresh Kumar Sanghi, J.(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, Gurcharan Singh, who has been booked for having committed the offences punishable under Sections 148, 323, 324 and 326 read with Section 149, IPC, in a case arising out of FIR No.161 dated 26.06.2014, registered at Police Station, Patti, District Tarn Taran.

Learned counsel contends that it is a case of version and cross-version; Balbir Singh, father of the petitioner, had sustained as many as four injuries including a grievous injury attracting the mischief of Section 326, IPC, at the hands of the complainant side of the present case; there was a delay of six days in reporting the matter to the police and that the petitioner is neither required nor involved in any other case. Criminal Misc.No.M-528 of 2015 [2] I have heard the learned counsel for the petitioner and with his able assistance gone through the material available on record.

As per the prosecution version, the petitioner was armed with kirpan and had caused the sharp-edged injury on the head of the injured, Ranjit Singh, which was later declared as grievous attracting the mischief of Section 326, IPC. The petitioner is the main accused and he cannot take benefit of the cross case at this stage.

No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
