(ORAL) Through this petition under Section 439 Cr.P.C., petitionerBaljinder Singh, has prayed for grant of regular bail in case FIR No. 1337 dated 30.12.2017 registered under Sections 148, 149, 302, 216, 120-B IPC and Section 25 of the Arms Act at Police Station City Panipat, District Panipat.
The petitioner is facing trial in the aforesaid FIR, on the allegations that on 30.12.2017, he along with his accomplice murdered Jai Dev Sharma, son of the complainant.
By placing on record, photocopies of statements of prosecution witnesses, learned counsel for the petitioner contends that all the material witnesses including complainant-Roshan Lal (PW-6), who is none else, but father of deceased-Jai Dev Sharma, have turned hostile. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Baljinder Singh, is ordered to be released on bail pending trial, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
