(ORAL) Learned counsel for the petitioner argues that though, the petitioner being eligible was allowed to compete for appointment to the post of Lower Division Clerk, which was advertised by the respondent Commission, vide advertisement No.11/2019 dated 05.07.2019, but now he has been been declared ineligible vide Annexure P-8. Learned counsel for the petitioner further argues that B.Com. Degree, which was an essential qualification, has already been supplied to the respondent Commission before the process of the selection started and the submission of the said degree with the Commission was also
-2brought to the notice of the Chairman and the petitioner was assured that he will be treated as an eligible candidate for competing against the post of Lower Division Clerk.
Learned counsel for the petitioner submits that after the petitioner was declared ineligible, he has already approached the respondent Commission by filing the representations dated 16.04.2021 and dated 04.06.2021 (Annexures P-9 & P-10 respectively), which are still pending consideration with the said authorities and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.1 to decide the said representations by passing an appropriate speaking order.

Mr. Sharad Aggarwal, Assistant Advocate General, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-Commission and raises no objection with regard to prayer of the petitioner for deciding the representations dated 16.04.2021 and dated 04.06.2021 (Annexures P-9 & P-10 respectively), by respondent No.1 in a time bound manner by passing an appropriate speaking order. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner in representations dated 16.04.2021 and dated 04.06.2021 (Annexures P-9 & P-10 respectively), respondent No.1 is directed to decide the representations dated 16.04.2021 and dated 04.06.2021 (Annexures P-9 & P-10 respectively), by passing a speaking order within a period of four
-3weeks from the date of receipt of a copy of this order. Present writ petition stands disposed of.
