***** SANJEEV PRAKASH SHARMA, J (ORAL) This is a petition filed under Section 439 Cr.P.C. for seeking regular bail in FIR No.164 dated 25.09.2022 under Section 171, 342, 376, 419, 506 IPC, registered at Police Station Women Jind, District Jind (Annexre P-1).

Learned counsel for the petitioner submits that the proseutrix has turned hostile and even from the medical report no rape can be said to have been committed. The petitioner is custody since 26.09.2022. Taking into consideration the statement of the prosecutrix where she has specifically mentioned of not having been forced upon by the petitioner, I am inclined to grant bail to the petitioner subject to furnishing of bail bond with a surety of Rs.20,000/- of the like amount. Accordingly, the petition stands allowed.
