($ All the above mentioned four writ petitions are being disposed of by a common order as the counsel for the respective parties agree that the dispute involved in all the petitions is identical. For the facility of reference, the facts are being taken from CWP12878 of 2009 titled as 'M/s National Rice Mills Vs. Union of India and others.'
Briefly summarized, the present petition invoked the writ jurisdiction of this Court for seeking issuance of writ in the nature of Certiorari/Mandamus for quashing the notice dated 28.11.2007 and the order dated 22.12.2008 alongwith all subsequent proceedings arising therefrom, whereby the respondent-FCI was seeking recovery of an amount of Rs.11,60,508/- on account of short delivery of rice to the respondent-FCI during the year 2004-05.
Learned counsel for the respondent-FCI has stated that the recovery in question has already been effected from the concerned agencies. Learned counsel for the petitioner thus submits that since the respondent-FCI has already effected recovery of the loss from the respective agencies, he has no surviving grievance in the present petition and the same may be disposed of as having been rendered infructuous. Disposed of accordingly. * )
