!"# $ Allegations against the petitioner Dev Kumar in this regular bail application under Section 439 Cr.P.C. in case FIR No.1 dated 08.01.2015 registered at Police Station Sehna, District Barnala under Sections 3047A/304 IPC are that while working as a Sub7Station Attendant had released electricity in the Grid System on account of which one person Swaran Singh was accidentally electrocuted who happens to have touched a live wire in the cremation ground of village Sehna.

Contentions of the petitioner's counsel that it was on account of own voluntary act and fault of the person in touching the live wire, has been controverted by learned State counsel submitting on instructions from ASI Jarnail Singh that during investigations nothing has come out that it was an act of own fault of the person. However, without going into the merits of the case, in view of the fact that the petitioner is in custody since 08.01.2015 and that the trial is not likely to accomplish in the near future, this Court is of the opinion that no useful purpose would be served by keeping the petitioner behind bars. Accordingly, he is ordered to be released on regular bail to the satisfaction of the trial Court. The petition stands disposed off accordingly. # %&'('')!*+,($ -.,' -/01"
