The petitioner apprehending his arrest in the FIR captioned above, has come up before this Court under Section 438 CrPC read with 482 Cr.P.C. seeking anticipatory bail. 2.

Vide order dated 22.07.2024, the petitioner was granted interim bail which is continuing till date.

Counsel for the petitioner submits that the amount corresponding to value of the vehicle in question stands paid.

Counsel appearing for respondent No.2 does not dispute this fact and submits that no settlement has yet taken place and opposes the bail for the reasons of interest part on delay payment. Counsel for the State opposes the bail but does not refute the submissions made by counsel for the petitioner.

Given the nature of allegation and the fact that there is no allegation that petitioner did not join investigation or failed to appear before the investigator concerned or hamper the investigation. The amount involved in the present case has already been paid. As such, the petitioner is entitled for bail.
