(ORAL) The petitioner, a Non-Banking Financial Company, has approached this Court seeking a direction to the District Magistrate, Rohtak (respondent No. 1) for deciding its application moved under Section 14 (2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short "the SARFAESI Act, 2002") for providing official assistance to take over physical possession of the secured asset.

It is urged that the aforesaid application is pending since last eighteen (18) months inspite of time limit provided under the proviso of Section 14 of the SARFAESI Act, 2002.

C.W.P. No. 12912 of 2021 (O&M) -2On the previous date of hearing, learned State Counsel, Mr. Vivek Saini, Additional Advocate General, Haryana, was directed to seek instructions from the official concerned. The reason for delay furnished is the prevailing circumstances due to COVID-19 Pandemic, as also the farmers' agitation in the area.

It is, however, assured that the pending application of the petitioner, which is now fixed for 06.08.2021, shall be decided in accordance with law at the earliest, preferably in the month of August-2021 only.

In view of above, it is conceded that nothing more survives for adjudication in the present writ petition.

Disposed of.
