This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.125 dated 12.10.2018 registered under Section 22 of NDPS Act, at Police Station Jhabal, District Tarn Taran.

Learned counsel for the petitioner submits that the petitioner had been granted interim bail by the trial Court vide order dated 06.12.2018, awaiting the FSL and had surrendered before the trial Court on 30.01.2023.

Learned State counsel has stated that after the surrender, the petitioner has directly filed this petition, instead of approaching the trial Court.

Learned counsel for the petitioner prays for withdrawal of the present petition to enable him to file an application before the trial Court. 5.

Ordered accordingly.
