******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.7 dated 08.01.2015 registered for offences punishable under Sections 148, 285, 341, 307, 427 read with Section 149 of Indian Penal Code and 25 of the Arms Act, at Police Station Kalanwali, District Sirsa. Heard.

As per case of prosecution, occurrence took place on 08.01.2015. Allegation against the petitioner is that he alongwith other persons followed the car of complainant and fired shots. They also hit Maruti Car of the complainant with their Scorpio car as a result of which Maruti car got overturned resulting in injuries to complainant and other occupants.

It is submitted that all the other co-accused are already on bail. The petitioner was initially declared proclaimed offender in this case and was arrested on 29.08.2016.

CRM-M-46364 of 2016 -2Learned State counsel submits that there are four other cases against the petitioner in which he is facing trial. Learned counsel for the petitioner submits that petitioner is on bail in all those cases. In this case challan has already been presented and trial is in progress. Keeping in view above facts and applying the principle of parity with other accused but without expressing any opinion on merits of the case, the present petition is allowed. Petitioner-Jaggi Singh @ Sukhraj Singh is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
