The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.34 dated 16.3.2019 at Police Station Nihal Singh Wala, District Moga under Sections 498-A and 406 of Indian Penal Code.

The FIR was registered at the instance of Amandeep Kaur, wherein it has been alleged that she was married to the petitioner Harpreet Singh on 15.1.2017 and although her father had spent an amount of `6 lacs, which was more than his capacity, but the petitioner and other members of his family were not happy with the same and used to pressurize her to bring more dowry.

The learned counsel for the petitioner has submitted that the parties have infact entered into a compromise and a petition for quashing of the FIR on the basis of compromise has already been filed. Pankaj Kakkar 2019.08.30 14:13 I attest to the accuracy and integrity of this document

Although, the learned State counsel has feigned ignorance about the compromise and has informed that the petitioner has since joined investigation.

Having regard to the facts and circumstances of the case from which it is borne out that the present case has arisen out of some matrimonial discord, which is stated to have been compromised and also bearing in mind the fact that the petitioner has joined investigation, in my opinion, the present case is not such which would warrant custodial interrogation. The present petition, as such, is accepted and the interim directions issued by this Court vide order dated 13.5.2019 are hereby made absolute subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 6.
