Mr. Puneet Sharma, Advocate and Mr. Shekhar Kumar, Advocate for the petitioner. * * * * The Labour Court had awarded a lum sum compensation of Rs.40,000/- in favour of the workman. The workman did not challenge the award. However, the Management, the petitioner, herein, challenged the said award by filing the present writ petition. The High Court vide order dated August 24, 2009 granted interim stay on the condition that the petitioner, herein, deposit Rs.40,000/- as awarded by the Labour Court with the Labour Court, Batala and the same shall not be disbursed to the workman till further orders. The said amount is, apparently lying with the Labour Court till today as the workman is stated to have not withdrawn the said amount. Learned Counsel for the petitioner had earlier submitted that he has no objection if the amount of Rs.

40,000/- is disbursed to the respondent-workman in full & final satisfaction of his claim. Respondent-workman has not put in appearance though he was duly served for today. Counsel for the petitioner submits that he has been instructed not to press this writ petition and submits that the writ petition may, consequently, be dismissed as not pressed. Learned Counsel also submits that the amount deposited by the petitioner be disbursed to the workman.

In view of the stand of the learned counsel for the petitioner, the writ petition is dismissed as not pressed.
