(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 1547 dated 16.11.2015, registered at Police Station City Panipat, District Panipat, who has been booked for having committed the offence punishable under Section 346 IPC (later on added 304-B/34 IPC).

Petitioner is mother-in-law of the deceased and there are general allegation against her, as the deceased was residing at her parental home at the time of death. Petitioner is an old lad having more than 73 years of age. Further the grandson of the petitioner (son of the deceased) is living with her in jail as there is no body outside the jail to look after the minor child.

The co-accused (Jeth) namely Phool Kumar having same allegations in the suicide note has already been granted regular bail by this Court on 07.12.2016 GAURAV ARORA 2017.01.24 13:40 I attest to the accuracy and integrity of this document Chandigarh

Crl. Misc. No. M-46394 of 2016 -2Petitioner is in custody since 29.04.2016 Learned State counsel on instruction submits that out of 19 witnesses, 03 have been examined so far.

Heard.

The fact which is not disputed that the minor child is living with the petitioner in jail and the co-accused Phool having similar allegations has been granted bail by this Court. The trial is also likely to take some time to conclude.

In view of the above, the present petition is allowed.
