(ORAL) Present petition has been filed for directing the respondents No. 2 and 3 to protect the lives and personal liberty of the petitioners and also directing respondents No. 4 and 5, not to interfere in the personal lives and liberty of the petitioners.
A co-ordinate Bench of this Court has already held in CRMM-20457-2019, Raj Rani and others Vs. State of Punjab others, decided on 06.05.2019 that for enforcement of fundamental right of protection to life and liberty, the remedy is a writ petition under Article 226 of the Constitution of India. Therefore, the instant petition under Section 482 Cr.P.C is not maintainable for protection of fundamental right. In view of the above, the present petition is dismissed.
