Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.439 dated 2.12.2014, under Sections 307/34 IPC and Section 25/27 of the Arms Act, registered at Police Station Kotwali, District Bathinda.

While issuing notice of motion on 19.2.2015, this Court has passed the following order :- "Learned counsel for the petitioner submits that complainant, Deepak Kumar has stated before the Additional Sessions Judge, Bathinda that it is not the petitioner who had fired at him (Annexure P2). Notice of motion for 02.03.2015."

Crl. Misc. No. M-5389 of 2015 -2does not dispute the statement suffered by the complainant Deepak Kumar made before the learned Additional Sessions Judge, Bathinda on 23.1.2015. Learned State counsel further states that the petitioner has joined the investigation on 30.1.2015 on the direction of learned trial Court and recovery has been effected from him. His custodial interrogation is no more required at this stage.

In view of the above facts, the petition is allowed and the petitioner is admitted to interim bail to the satisfaction of the Arresting Officer. It is made clear that the petitioner shall continue to join the investigation as and when required to do so and shall abide by all the conditions laid down under Section 438(2) Cr.P.C.
