The instant petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.63 dated 15.03.2023 (Annexure P-1) under Section 379 of the Indian Penal Code, 1860, registered at Police Station Sector-56, District Gurugram and all the subsequent proceedings arising therefrom.

Learned counsel for the petitioner submits that qua the same cause of action, another FIR stands registered in Rajasthan. On a pointed query put to the learned counsel as to what was the stage of the trial in the present FIR, he has informed the Court that it is still pending investigation. However, he submits that since the same case is the subject matter of the FIR, which stands registered against him in Rajasthan, it would amount to double jeopardy. 3.
On a further query put to the learned counsel as to whether the FIR in Rajasthan had also been lodged at the instance of the same complainant at whose instance the FIR at Gurugram was lodged, he has replied in the negative, and has submitted that the FIR in Rajasthan was registered under Section 379/411 of the IPC at the instantce of one Durg Singh. I have heard learned counsel for the parties and perused the relevant material placed on record.

Since the matter is still at a nascent stage, and pending investigation, no ground is made out to accept the prayer of the petitioner to quash the FIR in question.

As such, the petition stands dismissed.
