This is an application filed under Section 151 CPC, for placing on record the affidavit of applicant/appellant - Karamjit Kaur. II.

Counsel appearing on behalf of the applicant-appellant submits that two appeals are pending before this Hon'ble High Court, which were filed by both the sides i.e. present appeal i.e. RSA-1091-2021, and another appeal i.e. RSA-5496-2019.

Further submits that during the pendency of present appeal i.e. RSA-1091-2021, dispute between the parties has been resolved amicably, therefore, applicant-appellant wants to withdraw main appeal i.e. RSA-1091For the said purpose, one notarized affidavit dated 06.10.2023, has been executed by the applicant-appellant, and same is sought to be taken on record, for seeking withdrawal of main appeal. IV.

Notice of this application to the non-applicant/respondents. V.

At this stage, Mr. Samar Pratap Singh, Advocate for Mr. Akshay Kumar Jindal, Advocate, appearing on behalf of non-applicant/respondents, accepts notice on behalf of the JAWALA RAM 2023.10.10 17:16 I attest to the accuracy and integrity of this document

Counsel appearing on behalf of the non-applicant/respondents corroborates the factum of compromise having been arrived at between the parties, and he also pleads no objection to the prayer made in the application, as he has gone through the present application, which has been supplied to him in advance.

In view of above, prayer made in the application is allowed, and affidavit dated 06.10.2023, of the applicant-appellant, filed along with application is taken on record, subject to all just exceptions. Office to tag the same at appropriate place.

CM stands disposed of.

RSA-1091-2021 (O&M) 1.

As per the contents of the notarized affidavit dated 06.10.2023, filed on behalf of the appellant, in Court today, through Civil Miscellaneous Application i.e. CM-11425-C-2023, appellant - Karamjit Kaur, wishes to withdraw present appeal.

The factum of compromise having been arrived at between the parties as well as execution of one compromise-cum-settlement deed in this regard, has already been mentioned in said affidavit. Thus, appellant seeks withdrawal of main appeal.

Accordingly, present appeal stands dismissed as withdrawn. 4.

This order shall also dispose of all the pending misc. applications.
