CORAM:
HON'BLE MR. JUSTICE ANOOP CHITKARA
Present:
Mr. Amit Arora, Advocate for the petitioner(s).
Mr. H.S. Sitta, DAG, Punjab.
**** ANOOP CHITKARA, J. (Oral) Relying upon the status report, State counsel submits that petitioner no.1-Manpreet Singh has been found innocent during investigation and he has been absolved of all allegations leveled against him. Counsel for the petitioners submits that since petitioner no.1 has been declared innocent, this itself shows false implication of petitioner no.2 also and it becomes a ground for quashing of the FIR in question qua him. He seeks withdrawal of the present petition with liberty to file a fresh one qua petitioner no.2. Accordingly, the present petition is disposed of, having been withdrawn with liberty aforesaid. Apart from taking the above ground, the petitioner no.2 can raise any other grounds which are legally advised to her in the fresh petition. It is further clarified that disposal of the present petition shall not come in the way of petitioner no.2, in case she prefers a fresh petition on merits.
