The petitioner herein is a decree holder. The Executing Court has directed the petitioner to redeposit the excess amount already received by him.

The learned counsel representing the petitioner submits that this order has been passed without granting any opportunity of hearing to the petitioner.

A perusal of the impugned order shows that despite the repeated opportunities, the petitioner has failed to furnish the calculation sheet and failed to appear in the Court.

However, keeping in view the facts of the case, the present revision petition is disposed of while granting an opportunity to the petitioner to furnish his calculation sheet before the Executing Court within DEEPAK KUMAR BHARDWAJ 2023.10.19 10:31 I attest to the accuracy and integrity of this document

2023:PHHC:135204 Civil Revision No. 2898 of 2023 (O&M) a period of one week from today which shall be examined by the Executing Court within the next 15 days. Thereafter, the Executing Court will pass the appropriate orders, in accordance with law.
