(Oral) Instant petition has been filed under Section 482 Cr.P.C. for issuance of directions to respondent no. 4 restraining him from conducting second enquiry on the complaint of respondent no. 5 against the petitioner as per order dated 14.01.2009 of respondent no. 2 (Annexure P-2). Direction is also sought to respondent no. 4, not to harass and humiliate the petitioner at the instance of respondent no. 5.
Learned State counsel has filed reply/affidavit of Assistant Commissioner of Police (North), Jalandhar and the same is taken on record. As per reply, learned State counsel submits that the complaint was enquired by Assistant Commissioner of Police, Jalandhar and the same was found to be false and therefore, no action is being initiated. CRM-M-5433 of 2015 -2aggrieved with the enquiry conducted by respondent no. 4, respondent no. 5 filed another complaint in the NRI Sangat Darshan on 16.01.2015 and the said complaint was again marked to respondent no. 4. Now Sh. Paramjit Singh, ADCP-1, Jalandhar got conducted the enquiry into the said complaint and submitted his report dated 16.02.2015 and found the said complaint also false and recommended the same to be filed.
In view of the above, the instant petition has been rendered infructuous and the same is disposed as such. If the petitioner still has any grievance, he may seek appropriate remedy.
