...Respondents
CORAM: HON'BLE MR. JUSTICE NARESH KUMAR SANGHI
Present:
Mr. Bhrigu Dutt Sharma, Advocate, for the petitioner.
Mr. K.S. Pannu, DAG, Punjab, for respondent No. 1.
Mr. R.S. Sidhu, Advocate, for respondent No. 2.
NARESH KUMAR SANGHI, J (Oral) Learned counsel for the petitioner has pointed out that vide order dated 20.3.2013, the petitioner was directed to surrender before learned Trial Court and apply for bail. Learned Trial Court was also directed to release the petitioner on interim bail on furnishing of bail bonds and sureties to its
satisfaction.
In compliance of the above order, the petitioner appeared before the summoning/Trial Court and was admitted to ad-interim bail. Learned counsel for the petitioner further submits that since the petitioner is regularly appearing before learned Court below for the last two years and approximately eight months, therefore, the order dated 20.3.2013 be made absolute.
Learned counsel for the State on instructions from ASI Gurjeet Singh of Police Station, Patti, District Tarn Taran, submits that the petitioner was granted ad-interim bail by learned Court below and she is regularly attending the trial. Learned counsel for respondent No. 2/complainant has opposed grant of bail to the petitioner on the premise that it was wrongly averred that the address of the petitioner mentioned in the complaint was wrong or incomplete. In support of his submission, he attempted to convince this Court that same address as mentioned in the complaint by the complainant has been mentioned in the present petition. The memo of parties attached with this petition has been perused and it is found that two addresses mentioned in
the complaint and the memo of parties attached with the present petition are absolutely different.
After hearing learned counsel for the parties and going through the material available on record, the present petition is allowed. The interim directions issued vide order dated 20.3.2013 are made absolute. The petitioner shall continue to appear before learned Trial Court on each date of hearing unless ordered otherwise.
