(Presence marked through Video Conference) -.- ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to promote him as Assistant against the vacant post.

Learned counsel for the petitioner submits that petitioner was appointed as Clerk in the year 1990. He was later promoted to the post of Assistant in year, 2011. Due to unavoidable circumstances, petitioner sought reversion to the post of Clerk vide application dated 22.02.2017 and the same was accepted on 24.03.2017. He submits that 10 to 12 posts of Assistants are still lying vacant. In the premise, petitioner submitted a representation dated 04.09.2020 (Annexure P-3) seeking promotion, but the same has not been adverted by the respondents till date. Hence, the instant petition.

Learned State counsel, on advance service, joins proceedings and accepts notice on behalf of the respondent-State of Haryana and seeks time to file reply.

At this stage, learned counsel for the petitioner submits that let a final decision is taken, either way, by the respondents on the pending representation dated 04.09.2020 (Annexure P-3). 6.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per representation dated 04.09.2020 (Annexure P-3) and also by keeping in view the contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of 3 months from today. 9.

Disposed of accordingly.
