RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Jagdeep Singh in a case arising from FIR No.140 dated 18.07.2017 registered under Sections 307 and 34 IPC at Police Station City Moga, District Moga. Learned counsel for the petitioner inter alia contends that the petitioner is in custody since 02.09.2017. Initially FIR was registered against unknown persons and the complicity of the petitioner has been found in the instant case on the disclosure statement of his co-accused, namely, Dharam Pal and Maddi, which is a very weak type of evidence. Dharam Pal is the main accused to whom injury under Section 307 IPC is attributed. The aforesaid co-accused have shown the complicity of the petitioner in the present case empty handed and, thus, no injury is attributed to him.

On the other hand, learned State counsel vehemently opposed Ravinder Singh 2017.12.06 17:32 I attest to the accuracy and authenticity of this document prayer for grant of regular bail.

-2CRM-M-45590 of 2017 Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
