Mr. Sandeep Vermani, Addl.A.G. Punjab *** Ritu Bahri, J. (Oral) This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.147 dated 28.08.2017, under Section 22 of NDPS Act, registered at Police Station Sadar, Hoshiarpur, District Hoshiarpur.
Learned State counsel on instructions has informed that the recovery effected from the petitioner falls in the category of commercial quantity as per FSL report. As per custody certificate, the petitioner has undergone 01 year 07 months and 24 days of custody. In F.I.RNo. 62 dated 03.05.2018 under Section 22 of the NDPS Act, his sentence has been reduced to the period already undergone on 10.01.2020. Learned State counsel on instructions further submits that out of 08 witnesses, 03 have been examined and the next date is 16.09.2020. The petitioner is in custody since 28.12.2018.
