Learned counsel submits that the petitioners, who were working as Care Taker in the Directorate of Sainik Welfare, Punjab, reference in this regard is made to the appointment letter of petitioner No.6 dated 16.08.1989, appended as Annexure P-1 are seeking implementation of revised pay scale w.e.f. 01.01.1996 instead of 01.06.2001 as also dearness allowance, fixed medical allowance and interim relief etc. Reference is made to a decree dated 31.05.2002 passed by learned Civil Judge, Senior Division, Gurdaspur, Annexure P-7 in a suit filed claiming the same relief by one Rattan Lal son of Sewa Ram, retired Mali, Sainik Rest House, Gurdaspur, against which the appeal filed by State and RSA filed by Deputy Director, Sainik Welfare, Gurdaspur were also dismissed on 02.02.2005 and 29.01.2007 respectively. Therefore, he prays for reconsideration of the case, keeping in view of the above judgments.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to having a relook at the matter and decide afresh, taking note of the MOHIT 2025.05.22 10:09 I attest to the accuracy and integrity of this document

CWP-17364-2008 (O&M) -2aforesaid submissions and uninfluenced by the speaking order, within a period of 6 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 3.

The aforesaid satisfies the learned counsel for the petitioners. 4.

The matter stands disposed of accordingly and if the petitioners are found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same may be passed after granting opportunity of hearing to them and shall contain reasons, whereupon they shall be free to seek legal redress thereupon.
