This petition has been filed under Section 439(2) Cr.P.C. for cancellation of interim bail granted to accused-respondent No.2 by Additional Sessions Judge, Amritsar vide order dated 3.12.2016 (AnnexureP.2) in case FIR No.325 dated 4.11.2016 registered for the offences under Sections 323, 324, 326, 148, 149 and 34 IPC at Police Station Sultanwind, District Amritsar.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that first of all the present accusedrespondent No.2 is not named in the FIR. Secondly, there is a delay of four days in registration of the case. Respondent No.2 is not the main accused and he has not given the grievous injury. It is also in the order passed by the learned Additional Sessions Judge that the respondent No.2 is juvenile. Cr. Misc. No.M-46519 of 2016 Keeping in view the above facts, I find that no cogent ground is made out to cancel the anticipatory bail granted by Additional Sessions Judge, Amritsar vide impugned order dated 3.12.2016. No illegality has been committed by the learned Additional Sessions Judge, Amritsar. Therefore, I find no merit in this petition and the same is dismissed.
