Mr. Vikasdeep Singh, Advocate for the petitioner. HARINDER SINGH SIDHU, J The petitioner has assailed order dated 07.11.2020 passed by the learned Sub Divisional Judicial Magistrate, Sultanur Lodhi, declaring her as proclaimed offender.

It is stated that the petitioner is accused in case FIR No.193 dated 06.07.2020 under Sections 302,328,34,203 IPC registered at P.S Sultanpur Lodhi, District Kapurthala.

Learned counsel for the petitioner states that on an application dated 08.07.2020, an inquiry was conducted by the SSP, Kapurthala wherein the petitioner was found innocent. However, despite this proceedings were initiated against the petitioner and she was declared as P.O vide the order impugned. He submits that the petitioner had no intention to evade the process of law and that she undertakes to appear before the learned trial Court on any date to be fixed by this Court. Notice of motion.

CRM-M-27908 of 2021 (O&M) #2# account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 10.11.2021. On her doing so, she shall be enlarged on bail by the trial Court subject to her furnishing bail bonds and surety bonds to its satisfaction. She shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.

This shall, however, be subject to the petitioner depositing a sum of Rs.20,000/- in the Central Shaheed Ajit Singh Police Welfare Fund, O/o DGP, Punjab, Welfare Branch, CPO, Punjab.
