**** RITU BAHRI, J. (Oral) First petition for regular bail bearing CRM No.M-24624-2016 filed by the petitioner, was dismissed as withdrawn, by means of order dated 27.07.2016.

Now present second petition has been filed under Section 439 Cr.P.C. for grant of regular of bail to the petitioner in FIR No.48 dated 12.03.2016, under Section 304-B IPC, registered at Police Station City Moga, Tehsil and District Moga.

Learned counsel for the petitioner submits that since the petitioner has been falsely implicated in this case, therefore, he is entitled to the concession of regular bail.

The case of the prosecution is that Khushbu (deceased) was married to accused-Deepak Kumar about two years prior to her death. CRM-M-46538-2016 -2and finally she committed suicide. Ramesho, mother of the deceased, on learning about the incident, made statement before the Police, on the basis of which the present FIR was registered.

After hearing the learned counsel for the parties, going through the record, this Court is of the considered view that very serious and direct allegations are assigned to the petitioner. Taking into consideration the involvement of the petitioner, who is main accused and the gravity of indicated heinous offences, he is not entitled to the concession of regular bail and accordingly, the present second petition for regular bail filed by the petitioner is hereby dismissed as such.

Needless to mention that nothing observed, here-in-above, would reflect, in any manner, on merits of the main case, as the same has been so recorded for a limited purpose of deciding the present petition for regular bail.
