Through the present petition filed under Section 439 Cr.P.C., the petitioner seeks the grant of regular bail in FIR No. 813 dated 23.09.2016, registered under Sections 15/18 of the NDPS Act, at Police Station Hisar Sadar, District Hisar.
The case of the prosecution is that while travelling together, the petitioner along with Shaminder Singh and Gurchand Singh, was found in possession of narcotics. From the petitioner and Shaminder Singh, 450 grams of opium each was recovered.
Learned counsel for the petitioner relies on the grant of regular bail to Shaminder Singh, who had approached this Court through Crl. Misc. No. M-45129 of 2016. Crl. Misc. No. M-46545 of 2016 I have gone through the order dated 22.12.2016 passed by this Court in Crl. Misc. No. M-45129 of 2016 titled Shaminder Singh vs. State of Haryana, through which Shaminder Singh had been granted concession of regular bail. The petitioner's case, on parity, also deserves the same treatment.
It is also submitted by learned counsel for the petitioner that there is no other case pending against the petitioner. This fact is not disputed by learned State counsel.
