Learned counsel for the petitioner submits that petitioner has already joined the investigation but he is in custody in some other case for commission of offence under Section 307 IPC.

Learned State counsel submits that petitioner though joined the investigation but he is not cooperating with the investigating agency and recovery of `5,37,553/- has not been effected, which is the amount involved in the present case.

However, learned counsel for the petitioner further submits that the petitioner shall surrender before the area Magistrate/trial Magistrate and his application be decided expeditiously. 5.

Accordingly, in case, the petitioner surrenders before the area Magistrate/trial Magistrate, his application for regular bail, if any, shall be decided expeditiously and preferably within a period of one week by the concerned Court.
