*** HARSH BUNGER, J. (Oral) Prayer in the present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.44 dated 27.04.2019, registered at Police Station Bassi Pathana, District Fatehgarh Sahib, under Sections 306 and 506 of the Indian Penal Code, 1860 and order dated 30.04.2022 (Annexure P-4), passed by Additional Sessions Judge, whereby, the petitioner has been summoned with the aid of Section 319 Cr.P.C. so as to face trial for offences under Sections 306, 506 and 149 of the Indian Penal Code.

Learned counsel for the petitioner submits that in pursuance to order dated 02.06.2022, the petitioner has appeared before the trial Court and joined the proceedings.

Learned State counsel has not disputed the aforesaid fact of joining of trial by the petitioner and submits that his custodial interrogation is not required at this stage.

Since the petitioner has joined the trial and his custodial interrogation is not required at this stage, the present petition is allowed and the ad-interim order dated 02.06.2022 passed by Co-ordinate Bench of this Court is made absolute.

Nothing expressed here-in-above shall be construed to be an observation on merits of the case and the facts and circumstances recorded above are only for consideration of the prayer for anticipatory bail at this stage.

The petition is accordingly disposed of.
