It was submitted that name of the petitioner did not figure in the initial eye witness account of complainant Sita Ram, however, by way of supplementary statement vague allegation of he having inflicting lathi blow to one Bheem has been attributed. Police on investigation has found the petitioner innocent. CRM-M 4660/2016 to face trial.

Vide order dated 09.2.2016 notice of motion was issued and it was directed that in the event of petitioner surrendering before the trial court within 10 days,he shall be released on interim bail by the trial court to its satisfaction.

At the time of hearing,it is submitted that pursuant to the order dated 09.2.2016 petitioner surrendered before the trial court on 10.2.2016 and was released on interim bail.

The said fact is not disputed by the learned State counsel. In this view of the matter, interim bail granted by trial court vide order dated 10.2.2016 pursuant to the order dated 09.2.2016 passed by this Court is confirmed.

Disposed of.
