Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 17 dated 08.03.2019, registered under Section(s) 306 IPC at Police Station Block Majri, District S.A.S. Nagar, Mohali.

Learned counsel for the petitioner contended that petitioner has been falsely implicated in the present case at the instance of Surinder Singh alias Kala, who is elder brother of Jasbir Singh (since deceased). Learned counsel further contended that as per basic ingredients of Section 306 IPC, no case is made out for abetment for suicide against the petitioner. More so, petitioner is ready to join the investigation and as such, present petition be accepted.

Criminal Misc. No. M-21882 of 2019 application on the ground that allegation against the petitioner that he was having illicit relationship with Manpreet Kaur, wife of Jasbir Singh (since deceased) and as such, prayer has been made for dismissal of the present petition.

Having considered the submissions made by learned counsel for the parties, allegation against the petitioner are that Manpreet Kaur used to leave her house frequently without permission of her deceased husband because of her relations with the petitioner and because of that only Jasbir Singh had committed suicide. The matter requires detailed investigation and no case is made out to grant the concession of pre-arrest bail to the petitioner. As such, present petition stands dismissed.
