Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.34 dated 07.02.2017 under Sections 420, 467, 468, 471 and 120-B IPC, registered at Police Station Ambala Cantt. District Ambala.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learn State counsel and have gone through the record. As per the allegations in the FIR, 20 cases of candidates producing fake certificates or falsifying information i.e. school leaving certificate, caste, class, minority, resident, education and sports, for Vineet Gulati 2017.12.08 14:21 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-45761 of 2017 -2enrollment in Army have been detected. Though the present petitioner is not named in the FIR but later on, he is also nominated in the present case. As per the allegations, the present petitioner earlier appeared in the test for enrollment in the Army and produced a certificate showing date of birth as 02.06.1995. Later on, he produced the certificate of Open School Board showing date of birth as 12.02.1999.
Keeping in view the facts and circumstances of the present case, serious allegations against the present petition, I find that petitioner is required for custodial interrogation. No ground is made out for granting benefit of anticipatory bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.
