The petition in hand has been preferred under Section 528 of BNSS with the following substantive prayer(s):- "I. For quashing of the impugned proceedings initiated against the petitioner vide compliant no. 2153-CP-P, Dated 06.12.2025, Police Station Airport, Distict Amritsar in which summons has been issued dated 07.01.2026 (Annexure-2), at the behest of private respondent no. 7 who has submitted false complaint for abusing the police machinery to recover money from the petitioner, whereas, earlier similar complaint no. 2549-PC/COP, dated 09.05.2025 filed by private respondent no. 7 on same set of allegations against petitioner, which has been duly inquiry by respondent no. Assistant Commissioner Of police(West), Amritsar and in inquiry it has been categorically stated that no involvement has come against the Petitioner on the basis of Evidences/Witnesses presented private respondent no. 7/Jaswinder Singh;

II. Further it is prayed that any impugned proceedings arising out of similar complaint bearing no. 2153-CP-P, Dated 06.12.2025, Police Station Airport, District Amritsar in which summons has been issued dated 07.01.2026 (Annexure-2) may kindly be stayed, during the pendency of the aforesaid main case, in the interedt of Justice and fair-play; III. Further to decide representation dated 28.03.2026 (Annexure P-3) submitted by the petitioner to respondent.no. 2 and 3 in a time bound manner" 2.

CRM-M-20518-2026 P a g e | 2 direction is issued to respondent No.3 (Commissioner of Police, Amritsar) to consider and take a conscious decision on the representation dated 28.03.2026 made by the petitioner (copy whereof has been annexed as Annexure P-3 with the petition in hand) in a time-bound manner. 3.

Notice of motion.

On the strength of advance copy, Mr. Adhiraj Singh, AAG, Punjab accepts notice on behalf of respondents No.1 to 6. He has urged that he has no objection in case limited prayer made by the petitioner, for decision of his representation dated 28.03.2026 (Annexure P-3), is directed for. 5.

Having heard learned counsel for the rival party(s) and upon perusal of the paper-book, this Court deems it appropriate to dispose of the petition in hand with the following directions: (i) Respondent No.3 (Commissioner of Police, Amritsar) is mandated to look into the representation (Annexure P-3) moved by the petitioner, objectively consider the grievance(s) raised therein & take ratiocinated decision thereupon within a period of 30 days from today. Said decision be conveyed to the petitioner within 7 days thereafter (ii) No order as to costs.
