Mr. Ravi Kumar Girdhwal, Advocate for the complainant. HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.96 dated 08.04.2022 under Sections 379-B,365,120-B IPC, 34 IPC registered at P.S Salhawas, District Jhajjar.

FIR was registered on the complaint of one Labu Ram, who stated on 08.04.2022, he was going on his Mahindra Tractor along with his nephew and one Sita Ram. When he reached near Mahakal Hotel and stopped for taking meal, three boys came there and forcibly made his nephew get off the Tractor. One of the boys threatened them to leave the Tractor or they would be stabbed with the weapon being held by them. They slapped his nephew and forcibly made Sita Ram sit on the Tractor and went away with the tractor along with Sita Ram. Co-accused Hemant & Hitesh were arrested on 08.04.2022 and the Tractor was recovered from them. The petitioner was arrested on 09.04.2022 on their disclosure. CRM-M-25393 of 2022 #2# and the petitioner are known to each other. The matter has been compromised between them. The investigation in the case is complete and the petitioner has been in custody since 09.04.2022. Learned counsel for the complainant also affirms this fact. Without commenting anything on the merits of the case and also bearing in mind the fact of compromise having been arrived at between the parties, in my opinion, no useful purpose will be served by detaining the petitioner behind bars. The petition is allowed. The petitioner Krishan @ Kalu is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
