Present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to give ex-gratia appointment to the petitioner after the death of his father, as per the notification dated 02.08.2019 (Annexure P-2).

Learned counsel for the petitioners, inter alia, contends that the petitioner's father was appointed as Chowkidar w.e.f. 01.04.1996 and was promoted to the post of Salesman on 02.04.2004. His retirement date was

-230.04.2033 and he had expired on duty on 30.10.2021. At the time of his death his age was 46 years. He left behind his wife and son, who were fully dependent on the deceased. A copy of death certificate dated 26.11.2021 is annexed as (Annexure P-1). However, petitioner's mother filed an application on 07.12.2021 (Annexure P-3) for ex-gratia appointment of the petitioner on compassionate ground under Rule 4 of Haryana Civil Services (Compassionate Financial Assistance or Appointment) Rules, 2019. 3.

Learned counsel for the petitioner, at this stage, limits his prayer to the extent that the present petition be treated as a comprehensive representation and a direction may be issued to respondent No.2 to decide the same in a time bound manner by passing a speaking order, after affording an opportunity of hearing the petitioner.

Learned counsel for the respondents submits that he has no objection in case the direction is issued to respondent No.2-The Registrar Cooperative Societies Haryana for time bound consideration and decision thereof by passing a speaking order.

In view of the submissions made by learned counsel for the parties, present writ petition is disposed of and the respondent No.2 is directed to treat this writ petition as a comprehensive representation considering the claim of the petitioner and pass a speaking order after affording him an opportunity of hearing, within a period of three months from the date of receipt of certified copy of this order.

Further, the decision taken in the matter shall be conveyed to the

-3petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted to him forthwith by the respondent(s). 7.

All the pending miscellaneous application(s), if any, shall stand disposed of.
