For the reasons mentioned in the application, the same is allowed and Annexures A-1 and A-2 are taken on record, subject to all just exceptions.
CRM-M-23988-2023 Petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure, for setting aside the order dated 21.09.2022 passed by Sub-Divisional Judicial Magistrate, Khamano (Annexure P-7), whereby the petitioner has been declared as proclaimed offender in the case HIMANI GUPTA 2023.06.03 10:53 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

After arguing for sometime, learned counsel for the petitioner submits that the petitioner is ready and willing to surrender before the trial Court and hence he may be permitted to withdraw the present petition, however, he submits that an appropriate direction be issued that his application for regular bail be considered on the same day. 3.
In view of the above, the present petition is dismissed as withdrawn, however, in case the petitioner surrenders before the trial Court within a period of one week from today and moves an application for grant of regular bail, the same shall be considered by the learned trial Court expeditiously and preferably with seven days from the day of filing of the application for grant of regular bail, in accordance with law. 4.
The petition is accordingly disposed of.
