******* SURINDER GUPTA, J.(Oral) Present petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No. 44 dated 31.03.2016 registered for offences punishable under Sections 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Mehatpur, District Jalandhar (Rural). Heard.

As per case of prosecution, instant FIR was registered on the basis of secret information that petitioners can be apprehended with contraband. When the raid was conducted all the accused named in secret information ran away from the spot and no recovery was effected. CRM-M-46716 of 2016 -2CRM-M-46716-2016 and petitioner-Boota Singh in CRM-M-46728-2016 have joined the investigation and have been allowed bail under order dated 28.12.2016.

As no recovery has been effected from petitioners and the matter is still under investigation, both the petitions are allowed and order dated 28.12.2016 allowing them interim bail is made absolute till presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that petitioners shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
