    This is the fourth petition for grant of bail, pending trial, in a criminal case arising from FIR No.17, dated 21.01.2019, registered under Sections 15 and 29 of the NDPS Act, 1985, at Police Station Dharamkot, District Moga.

The first application was dismissed on 15.11.2019 with the following order:- "Petitioner prays for grant of bail pending trial in a criminal case arising out from FIR No.17, dated 21.01.2019, registered under Sections 15/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Dharamkot, District Moga.

As per the case of the prosecution, petitioner was found in conscious possession of 150 Kg of poppy husk. This court has heard learned counsels for the parties at length and with their able assistance gone through the paper book.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated due to a property dispute and the vehicle through which the narcotics were brought does not belong to the petitioner.

ASHOK KUMAR 2021.08.10 09:40 I attest to the accuracy and integrity of this document CRM-M-28771-2021 (O&M) On the other hand, learned counsel for the State has submitted that huge quantity of narcotics have been recovered from the conscious possession of the petitioner who was found sitting on 5 bags full of poppy husk, total weighing 150 Kg. Keeping in view the facts of the case and bar to grant of bail as provided under Section 37 of the NDPS Act, this Court is not inclined to grant concession of bail to the petitioner. Dismissed."

Thereafter, the second petition was dismissed on 25.02.2020. The third petition was dismissed on 04.11.2020. Although, the learned counsel representing the petitioner made sincere attempts, however, failed to draw the attention of the Court to any fresh ground for bail or change in the circumstances. Hence, dismissed.

All the pending miscellaneous applications, if any, are also disposed of.
