Learned Legal Aid Counsel submits that the only prayer made by the petitioner is that direction be issued to settle the matter, whereas there is specific statutory provision under Section 147 of the Negotiable Instruments Act, 1881 in this regard. Apart from that, judicial pronouncement in M/S Meters And Instruments vs Kanchan Mehta, CRIMINAL APPEAL NO. 1731 OF 2017 dated 5.10.2017 is very clear on it. Consequently, the present petition is not maintainable. Accordingly, the present petition is disposed of, with liberty to the petitioner to file an application under Section 147 of the Negotiable Instruments Act, 1881 and judicial pronouncement in M/S Meters And Instruments vs Kanchan Mehta (supra).
