RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Parsh Ram in a case arising from FIR No.146 dated 25.08.2017 registered under Sections 307, 353, 186, 427, 148, 109, 149 and 120-B IPC at Police Station Dirba, District Sangrur. According to the prosecution, petitioner along with his co-accused Harwinder Singh and Harbans Singh was sitting on the rear seat of Swift Dezire car bearing registration No.PB-28-E-0377 driven by Satpal Singh. They were apprehended at the spot. Bottles of petrol were recovered from them, which they were carrying to disturb the law and order situation in the State on account of conviction of self-styled Baba Gurmeet Ram Rahim. Learned counsel for the petitioners inter alia contends that the petitioner is in custody since 25.08.
2017. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioner in jail. Co-accused of the petitioner, namely, Harwinder Singh, Harbans Ravinder Singh 2017.12.
-2CRM-M-45855 of 2017 have been granted regular bail by this Court vide orders dated 01.12.2017 and 20.11.2017, respectively.
On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioner. Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, taking the case of the petitioner on the same parity as that of his co-accused, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
