**** ANOOP CHITKARA, J. (Oral) Feeling aggrieved by framing of charges in her absence, the accused has come up before this Court by filing the present revision petition under Section 401 CrPC.
The complainant is represented by his counsel and the State has also got instructions in this regard. State counsel submits that initially, the petitioner was arraigned as an accused, however, later on, in inquiry, she was not found present at the spot and accordingly, supplementary challan dated 14.10.2021 was filed, declaring her innocent.
However, a perusal of the impugned order dated 2.3.2023 reveals that there is no reference to the supplementary challan. Given above, the impugned order is set aside. It is clarified that in case the concerned Court wants to proceed further by framing charges against the petitioner, it shall refer to the supplementary challan, vide which the petitioner was declared innocent.
