**** Harpreet Singh Brar, J. (Oral) Present petition has been preferred against the judgment dated 17.07.2012 passed by learned Addl. Sessions Judge, Kaithal vide which judgment of conviction dated 05.04.2010 passed by learned Chief Judicial Magistrate, Kaithal was upheld while order of sentence dated 07.04.2010 is modified by reducing the sentence from three years to two years in case stemming from FIR No.11 dated 03.04.2001 registered under Section 409 IPC registered at Police Station SVB Ambala.

2. Learned State counsel, at the very outset, on instructions from ASI Balaur Singh Bhatti, submits that during the pendency of present petition, petitioner - Sudarshan Kumar has passed away.
