Mr. Ram Bilas Gupta, Advocate for the respondent. *** ANIL KSHETARPAL, J (Oral) On 24.08.2021, the following order was passed:- "This petition has been filed by the wife seeking the transfer of the petition filed under Section 9 of the Hindu Marriage Act, 1955, bearing No.HMA/1319/2020, titled as 'Deepak vs. Sonam' pending in the Court of District Judge, Family Court, Faridabad to the Court of competent jurisdiction at Palwal.

The petitioner claims that she got married to the respondent on 08.12.2017. She claims that at present, she is residing with her parents at Palwal and cannot properly defend the petition at Faridabad as the distance between the two places is 30-40 kms.

Notice of motion for 10.09.2021.

The liberty is granted to the petitioner to serve the respondent through his counsel Sh. Purushottam Bhardwaj, District Court, Faridabad.

Learned counsel representing the petitioner contends that the petitioner's mother is a labourer and the petitioner does not have any independent source of income.

Keeping in view the aforesaid facts, the petition is allowed. The proceedings of HMA/1319/2020 (Deepak vs. Sonam) pending in the Court of District Judge, Family Court, Faridabad, are ordered to be transferred to the ASHOK KUMAR 2021.09.15 10:21 I attest to the accuracy and integrity of this document

TA-615-2021 (O&M) Court of competent jurisdiction at Palwal. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Palwal, on 05.10.2021 who shall either decide the matter himself or assign it to the Court of competent jurisdiction at Palwal.
