JASWANT SINGH, J (ORAL) Prayer is for grant of anticipatory bail in case FIR No.127 dated 02.09.2014, under Sections 328,376D,506,34 IPC registered at P.S Raipur Rani, District Panchkula.

It is submitted that the alleged occurrence in the back seat of a Car is of dated 01.09.2014 and the complainant in her first statement under Section 164 Cr.P.C before the Magistrate on 03.09.2014 did not name the petitioner or anybody else except one Sameer Chhiber, who stands acquitted of the charges by the learned Addl. Sessions Judge, Panchkula vide judgment dated 30.04.2015. Learned counsel, thus, contends that a false case has been foisted and in any case, the petitioner has joined investigation. Learned state counsel, on instructions from Rameshwar Nand ASI, states that the petitioner has joined investigation, which are complete and the challan has been prepared and that custodial interrogation is no longer required.

In view of the above, order dated 31.3.2015 passed by this Court granting anticipatory bail is made absolute. Petition stands disposed of.
