(ORAL) The appellants have come up in appeal against the order dated 23.11.2020 passed by the learned Single Judge, whereby the writ petition filed by the petitioner (respondent No. 1 herein) was admitted and the suspension order and the subsequent proceedings relating to the charge-sheet against him had been stayed.

Further, the appellants have also challenged the order dated 25.02.2021 passed by the learned Single Judge dismissing CM-2943-2021 seeking vacation of stay.

Learned counsel for respondent No. 1 informs that during the pendency of the appeal, respondent No. 1 has retired and the main case is fixed for 07.02.2024 before the learned Single Judge. Since respondent No. 1 has already retired, the present appeal has been rendered infructuous and is dismissed as such. Let the writ petition pending before the learned Single Judge be decided on merits.
